1. Identification of the Accommodation

This website is operated by the company Garway, Lda, with Portuguese  NIF 513902180, and address at Canada dos Areeiros 22, 9500-026, Fajã de Cima – Ponta Delgada, operator of the Local Accommodation establishment called Ilha Hostel and Suites, registered in the National Registry of Local Accommodation (RNAL) under number 2651/AL.

2. Object and Scope of Application

These Terms and Conditions govern the use of the website and the bookings made through it. By making a reservation, the guest declares that he has read, understood and fully accepts these Terms and Conditions.

3. Booking Conditions

1. Reservations can be made through this website, through the email address reservas@ilhaazores.com, or through Booking.com and Airbnb platforms, and are subject to the availability of the accommodation.
2. The reservation is only considered valid after confirmation by the accommodation and, when applicable, receipt of the payment or deposit.
3. The holder of the reservation must be at least 18 years old.
4. The maximum number of guests allowed is the one indicated in the description of each room booked, and it is not allowed to exceed it.

4. Prices and Payments

1. All prices shown are euros (€).
2. Prices include breakfast every day and intermediate cleaning and change of bedlinen and towels, every 3 days.
3. VAT is included in the booking price.
4. Accepted payment methods are bank transfer, cash or card (debit and credit). If you want to pay at the accommodation, you can do so on the day of your check-in, but you will have to inform the accommodation to the email reservas@ilhaazores.com and wait for confirmation.
5. A deposit or prepayment of the amount of money may be requested for confirmation of the reservation, especially for group or multi-room bookings.

5. Regional Tourist Tax

At check-in, it is mandatory to pay the current municipal tourist tax, in the amount of €2 per person and night, up to a maximum of 3 consecutive nights.

Payment must be made only in cash, or by bank transfer up to 5 days before check-in.

The tax is for guests aged 13 and over.

Exemptions

– Guests whose stay in the municipality is motivated by obtaining medical services, for the days necessary for treatment, plus an overnight stay, extending this exemption to one person, for the purpose of accompanying the sick guest, and even if the latter does not stay overnight in the accommodation for health reasons (present a copy of the document proving the appointment or provision of medical services);

– Guests with a physical disability equal to or greater than 60% (present a document proving the condition of disability);

– Residents in the Azores (present proof of recent residence).

6. Cancellation Policy and Modifications

1. All reservations made on the website can be canceled, free of charge, for up to 7 days before check-in.
2. For cancellations made 6 days before check-in, 50% of the stay may be charged.
3. Cancellations made 2 days before check-in, 100% of the stay may be charged.
4. No-shows imply the loss of the amount paid.
5. Early departures will be charged 100% of the total amount of the stay.
6. Changes to the booking dates are subject to availability and eventual price adjustment.

7. Check-in and Check-out

• Check-in: from 3pm.
• Check-out: until 11:30 am.

There is no possibility of check-in before 08:00am.

Late check-out is subject to availability and only in low season (November-March).

8. Front-Desk

Front-desk has limited hours from 08:00 am to 05:00 pm and can be changed at any time without prior notice.

The accommodation works with access codes to the building and rooms, which are sent on the booking confirmation.

If you arrive after reception opening hours, you must use your access code to access the building and the room, and the next day go to reception to check in.

9. Accommodation Rules

1. Smoking is not allowed inside the accommodation.
2. Pets are not allowed.
3. No parties or events are allowed.
4. Guests must respect rest times and rules of coexistence, namely regarding noise.
5. Accommodation must be used responsibly and appropriately.
6. Guests under the age of 18 must be accompanied by a responsible adult.
7. All guests will have to provide their IDs for check-in and data collection purposes for SEF/AIMA (Foreigners and Borders Service). The identification of minors is requested to those responsible for them.

10. Security and Damages

The guest is responsible for any damage caused to the accommodation or its equipment.

A security deposit may be requested to repair the damage caused.

11. Liability

1. The accommodation is not responsible for loss, damage or theft of guests’ personal belongings.
2. The guest is responsible for the correct use of the accommodation during the stay.
3. The accommodation cannot be held responsible for non-compliance resulting from situations of force majeure.

12. Protection of Personal Data

The personal data collected is processed in accordance with the legislation in force and the General Data Protection Regulation (GDPR). For more information, please see our Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by Portuguese law. In the event of a dispute, the consumer may resort to CIMARA – Information, Mediation and Arbitration Centre of the Autonomous Region of the Azores, located at Rua de Ernesto do Canto, 40, 1.º, 9500-312 Ponta Delgada, Azores, Portugal, or to another recognized alternative dispute resolution entity.

14. Changes to the Terms and Conditions

The accommodation reserves the right to change these Terms and Conditions at any time. Changes take effect upon their publication on the website.
